Nabil Abdulrab almotamar.net - SANAA-As part of the process of reforming the legislative system and of closing inlets of corruption, the government submitted Tuesday to the parliament a draft law for tenders and bids and government warehouses to be alternative to law No. (3) for the year 1997. the new law aims to realize justice and equality among contesters in tenders and biddings as well as decency and transparency and control and definition of measures related to tenders and bids and stores. The new law is also intended to realize economic efficiency in those tenders and monitoring their procedures.

The new draft law provisions include all ministries, public establishments, specialized funds and different sides in the central authority and its branches of local authority administration units as well as the sides included in the general budget of the state. The law provisions also include administration units of the local authority, units of the public sector of civil character and sides of independent budgets. The law does not cover activities purchases, importations and contracts that are concluded according to agreements of loans and grants endorsed upon except if there is stipulation on that in those agreements.

The new draft law obliged all units of the public sector of productive character, units of the mixed sector and the ministry of defence to draw up their own regulations for the organization of the works of tenders and bids compatible with goals of the tenders� law and its regulations. The new law is distinguished by the formation of an independent higher commission to be called �The Higher Commission for Monitoring Tenders and Bids�. The commission is run by a board of directors composed of a chairman and eight members. President of the republic selects seven from a list composed of 14 persons nominated by the Shoura Council from those possessing legal conditions and three of them must be representatives of civil society organizations in addition to two judges holding the degree of judge at a supreme court to be nominated by the Judiciary Supreme Council.
